The Last Will and Testament
"The Will" is generally what attorneys are asked to compose for people. If you have more than $25,000 in assets, it is a good idea to have a Will. There are thousands of requirements for wills, too difficult to list here. If you do not want to hire an attorney for a will, you can find a will on the internet or in an office supply store. This is much cheaper than the attorney drafted document, which is $150 for a simple one. A married couple is charged $200 if their wills are similar and they come together. This attorney has found most pre-printed wills in kits are good. The problem comes when the client incorrectly fills in the blanks or incorrectly performs the signing ceremony.
So, here's a pitch for the Attorney Drafted Will. There is the security of knowing it is written in the proper legal terminology. It is printed on cotton bond, prominently identified with a cover and jacket, and the signing ceremony is performed according to all legal requirements in the presence of the attorney and notary. Copies are immediately generated so that one is kept in the law office (Wills are no longer recorded before death, as was done in past generations).
